Terms of Use

1. Agreement

These terms apply to the website soundmeasure.ai and to the products published by Sound Measure Labs LLC ("Sound Measure Labs", "we"). By using the site or a product, you agree to them. If you do not agree, do not use the site or the product.

2. Site content

The text, design, logo, illustrations and code of this website belong to Sound Measure Labs or its licensors. You may read, link to and quote the site for personal, educational or journalistic use with attribution. Press assets on the Press page may be used to write about Sound Measure Labs, as supplied and without alteration. Any other use requires our written permission.

3. Product licenses

Unless a product's page states otherwise, each product we distribute through the App Store is licensed to you under Apple's Licensed Application End User License Agreement. The license is for your use only and does not transfer ownership. You may not copy, modify, reverse engineer or redistribute a product except as that agreement or applicable law allows.

4. Purchases

Purchases and subscriptions are handled by Apple under its terms. Prices are shown before you buy. Refunds are requested from Apple, and subscriptions are managed in your Apple Account settings. We do not receive or store payment details.

5. Services

Product development, research and advisory services are provided under separate written agreements. Nothing on this website is an offer to provide services, and these terms do not govern any engagement.

6. Warranty disclaimer

The website and our products are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site or a product will be uninterrupted or error free. Some jurisdictions do not allow these exclusions, so some of them may not apply to you.

7. Limitation of liability

To the fullest extent permitted by law, Sound Measure Labs is not liable for any indirect, incidental, special or consequential damages arising from your use of the website or a product. Our total liability for any claim relating to a product is limited to the amount you paid for it in the twelve months before the claim.

8. Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Suffolk County, New York.

9. Changes to these terms

When we change these terms, we update the effective date at the top of this page. Continued use of the site or a product after a change means you accept the new terms.
